binding agreement between you and GamePoint. These Terms & Conditions govern
your use of The Services and related Services. By downloading and/or using
The Services, you agree to be bound by the terms and conditions of these
Terms & Conditions. In case you do not agree to the Terms & Conditions,
you are not able to use The Services.

You may not use The Services or agree to these Terms & Conditions if you are under 18 years old.
By downloading and/or using The Services, you acknowledge that you are at least 18 years old.
GamePoint may immediately suspend your access to the Services if we are not satisfied that you are 18 years or older.

1. Terminology
The following definitions are used in the Terms & Conditions:
Application(s): The applications which can be downloaded to play one or more specific Game(s).
Distribution Partner: The operator of the Distribution Platform, including Apple with respect to the App Store and Google with respect to Google Play.
Distribution Platform: Any digital distribution platform operated by a third party by means of which the User acquired access to the Application(s), including the App Store and Google Play.
Distribution Platform T&Cs: The terms and conditions of the relevant Distribution Platform by means of which the User lawfully acquired the Application(s).
Feedback: Has the meaning as described in clause 6.6 of the Terms & Conditions.
Fiat Currency: Any real-world currency, including but not limited to Euros, USD or GBP.
GamePoint: GamePoint B.V., a private company with limited liability incorporated in the Netherlands (KvK number: 27169445), having its address at Andries Bickerweg 1A, 2517 JP, The Hague, the Netherlands.
Game(s): The games which are made available at any given time via the Website or as an Application.
Intellectual Property Rights: All copyrights, database rights, trademarks and other intellectual property rights wherever in the world, whether registrable or unregistrable, registered or unregistered, including any application or right of application for such rights.
Service(s): The services which are provided by GamePoint to you, including but not limited to:
The Application(s);
The Website;
The Game(s) which are playable as an Application or are playable on the Website.
Terms & Conditions: These terms & conditions, including any amendments from time to time.
Unsolicited Content: Has the meaning as described in clause 6.5 of the Terms & Conditions.
Update: A hotfix, patch or version update or (minor or major) upgrade to the Services.
User: The person to whom GamePoint grants a right to use the Services under and in accordance with these Terms & Conditions Alternatively, the User will be referred to as “you” in these Terms & Conditions.
User Content: All works and materials (including text and images) that the User submits to The Services or has created based on and/or with The Services.
Virtual Currency: The virtual premium currency that can be bought in the Game(s).
Virtual Items: The virtual items that can be bought in the Game(s).
Website: The websites which are used by GamePoint to provide you access with Game(s), including www.gamepoint.com.
2. License
2.1 GamePoint hereby grants you a personal, revocable, non-exclusive, non-transferable license to:
A. Create an Account; and
In case of the Website;
B. Use the Website (and play the Games on the Website) for your personal enjoyment and non-commercial purposes; or
In case of an Application:
C. Download a copy of the Application on your hardware; and
D. Use the Application on your hardware for your personal enjoyment and for non-commercial purposes.
2.2 The license that is granted to you under article 2.1 of this Terms & Conditions is subject to your compliance with all terms and conditions of these Terms & Conditions. GamePoint has the right to suspend and/or terminate your license to the Services in case you do not comply with these terms and conditions.
3. Account
3.1 To use the Services, you will need to register for an Account. To register for an Account, you will need to submit certain information such as a username and a password. Creation and operation of an Account is subject to these Terms & Conditions.
3.2 You warrant and undertake that all the information you supply during registration for your Account is truthful, complete and correct. You accept and understand that you are obligated to ensure that all information held about you by GamePoint is up to date. You can notify an update to your registration details at any time by editing the information contained within your Account.
3.3 If GamePoint is notified or otherwise has reason to believe that the information you have provided is fully or partly inaccurate, incomplete or not up-to-date, GamePoint has the right to request that you provide updated information without delay. If you fail to provide, correct, update or complete the information as requested, GamePoint is entitled to block you from using the Services until you have fully complied with the request.
3.4 Any username and password chosen by or issued to you upon or for registration with GamePoint is personal to you and should only be used to facilitate your use of and access to the Services. You agree that you must not disclose your username or password to any third party without GamePoint’s prior written consent.
3.5 If you believe that the security of your username, password or Account may have been compromised, you must inform GamePoint immediately. GamePoint is not liable for any damages as result of your account being compromised.
3.6 You accept and understand that you are solely responsible for all use of the Services undertaken through your Account and by use of your username and password. Do not share your account name or password with any other person or allow any other person to use your account. GamePoint is not liable for losses or damage resulting from any negligent or improper use of your account name, password, account or any use by any third party that results from failure to comply with these terms.
3.7 You may close your Account with GamePoint at any time by asking us to delete your Account by emailing [email protected] or using the “Delete my Account” button within your Account. This also terminates the Terms & Conditions and ends your right to use the Services.
3.8 Without prejudice to other remedies, GamePoint may immediately restrict, suspend, or terminate your Account and your access to and use of the Services, or any part of them, if:
GamePoint has reasonable cause to believe that you have sold and/or transferred your Account to any third party;
GamePoint has reasonable cause to believe that you are creating problems or possible legal liabilities for, or are infringing the rights of, GamePoint, any of our Users or third parties;
GamePoint has reasonable cause to believe that such restrictions will improve the security of the GamePoint community or reduce our or a User’s exposure to financial liabilities;
GamePoint has reasonable cause to believe that you are violating these Terms & Conditions or any policies of GamePoint; or
Despite the reasonable efforts of GamePoint, it is unable to verify or authenticate any information you provide to us.
3.9 GamePoint reserves the right to terminate your Account if no activity is conducted by you in relation to the Account for 180 or more days. In such event, no refund will be offered to you for any Virtual Currency and/or Virtual Items in your Account.
3.10 If your Account has been terminated or suspended by GamePoint, you may no longer use the Services.
4. Virtual currency & virtual items
4.1 GamePoint provides an in-game ecosystem for Users. The Games are free to play, which means that you are not obliged to pay to be able to play and enjoy the Games. In some Games, it is possible to buy Virtual Currency and/or Virtual Items.
4.2 The prize of Virtual Currency and/or Virtual items is mentioned on the Website or in the relevant Application. These prizes are applicable, except in the event of an obvious mistake in the pricing. Prices mentioned include VAT and other charges but excluding any charges from your payment provider.
4.3 When you acquire Virtual Currency and/or Virtual Items, you receive a limited, non-exclusive, non-refundable, non-transferable, revocable license to use them for your personal entertainment, in connection with the Services, and in the ways permitted by the Terms & Conditions.
4.4 Neither Virtual Currency nor Virtual Items have any monetary value, and neither is it tied to any real-world currency, which means that they are not a substitute for Fiat Currency, and they don’t earn interest.
4.5 You are not allowed to use or distribute Virtual Currency and/or Virtual Items, except through the Services and as expressly allowed under the Terms & Conditions. This means that it is not allowed to sell, transfer or otherwise provide access to the Virtual Currency and/or Virtual Items for Fiat Currency. GamePoint does not recognize or take responsibility for any third-party services that may allow you to sell, transfer, or otherwise use Virtual Currency and/or Virtual Items outside of GamePoint and its Services, and any such use by you is a violation of the Terms & Conditions.
4.6 Any (attempt to) use of Virtual Currency or Virtual Items that violates the Terms & Conditions will be automatically cancelled and may result in immediate termination of your Account and your right to use the Services.
4.7 GamePoint may put limits on Virtual Currency and/or Virtual Items. This includes the right to modify, revoke or terminate your license to use them without any liability to you. This also means that some Virtual Currency and/or Virtual Items have an expiration date, which will be communicated to you via the Game(s).
4.8 If your Account has been closed and your right to use the Services has been terminated, you will lose all rights of use you may have acquired during your use of the Services, including your rights in all Virtual Currency & Virtual Items you have acquired without any compensation owed to you by GamePoint, by other Users, or by any other third party.
4.9 Right of withdrawal waiver for Virtual Currency and/or Virtual Goods (in case you are residing in the European Union):
You expressly waive your right of withdrawal for the delivery of digital content not supplied on a tangible medium, provided that the performance has commenced with your explicit prior consent and you have declared that you have waived your right of withdrawal, unless the law in your jurisdiction provides otherwise. This section does not affect your statutory rights;
You expressly waive your right of withdrawal for the delivery of services, after full completion of the service, provided that the performance has commenced with your explicit prior consent and you have declared to waive your right of withdrawal as soon as we have completed the contract in full, unless the law in your jurisdiction provides otherwise. 5. Rules of play & conduct
5.1 Each Game which can be played (as part of the Services) has its own rules of play, scoring mechanisms and guidelines, which can be found in the game environment. In the event that these elements contain binding rules, these are part of these Terms & Conditions.
5.2 You will comply with the following obligations when using and/or operating the Services:
You will not cheat when using the Services or take unfair advantage of errors and/or bugs;
You will not share information and/or content that is misleading or untruthful;
You will not share information and/or content that is libelous, defamatory, abusive, harassing, threatening, bullying, racist, discriminatory or hateful;
You will not share information and/or content that is erotic and/or pornographic;
You will not use our Services to encourage the abuse or exploitation of children in any way possible;
You will not share information and/or content that contains hyperlinks, torrents or similar information that includes and/or refers to material that infringes the rights of third parties;
You will not share information and/or content that contains commercial, charitable and/or idealistic communication;
You will not share information and/or content that contains viruses, malware, trojan horses, worms, bots or other (malicious) software;
You will not share information and/or content that contain tools and/or solutions with which the Services can be examined and/or used in an improper way;
You will not share information and/or content which infringes the rights, reputation of interests of GamePoint and/or third parties;
You will not share information and/or content which is unlawful;
You will not publicly name and/or reveal the identity of any other player;
You will not impersonate another person or falsely imply that you are an employee and/or representative of GamePoint;
You will not interfere with or disrupt any server and/or network used to support or provide the Services (including any hacking or cracking into the Services);
You will not interfere with and/or disrupt another player’s use of the Services;
You will not negatively affect other users’ enjoyment of the Services.
5.3 You will comply with the following obligations when using and/or operating the Services:
You will not copy, modify or create derivative works of the Services or any part of it, including data held in memory;
You will not distribute, transfer, sublicense, lease, lend, rent, grant a security interest in or otherwise provide access to the Services to any third party;
You will not buy, sell or transfer (the contents of) your account of the Services;
You will not modify, alter, edit, adapt or create derivative works of the Services;
You will not reproduce, decompile and/or reverse engineer the Services, except if this is authorized by mandatory law;
You will not conduct any systematic or automated data collection activities (including scraping, data mining, data extraction and data harvesting);
You will not delete, remove, disable or circumvent any security protection measures, anti-cheating measures or proprietary notices in or associated with The Services;
You will not violate any law, rule and/or regulation
6. User Content & Feedback
6.1 The Intellectual Property Rights regarding your User Content remains vested in and owned by you. Notwithstanding the foregoing, you grant GamePoint a worldwide, non-exclusive, royalty-free, transferrable, sub-licensable and irrevocable license to use your User Content for any purpose.
This means, amongst other things, that:
You agree that GamePoint may use your User Content in any media and channels of distribution now known or developed hereafter, including in connection with marketing and advertising for the Services;
You agree that GamePoint may use your User Content for non-commercial and educational purposes in the context of The Services without your approval; and
You agree that to the extent permitted under applicable law, you waive your moral rights in the User Content and agree not to assert such rights or any other intellectual property rights you have in the User Content against GamePoint.
6.2 You guarantee that the User Content:
A. Complies with these Terms & Conditions; and
B. Does not infringe any third party right, including Intellectual Property Rights.
6.3 GamePoint has the right to remove uploaded User Content from its Services at its sole discretion. GamePoint will use its right if GamePoint decides that the User Content results in or from a breach of any part of these Terms & Conditions, or that it may bring GamePoint or the Services into disrepute (amongst other scenarios). However, you acknowledge that we do not actively monitor User Content that is contributed by people that use our Services and we make no undertaking to do so.
6.4 By accessing and/or playing those of our Games which allow you to play against an opponent or to play socially, you agree to your display name, profile picture (avatar), scores, and other related details being displayed to other users.
6.5 GamePoint does not accept any unsolicited feedback or ideas, including submissions around concepts, creative ideas, suggestions, stories, scripts, products, games or any other potential creative content (together “Unsolicited Content”). By nonetheless providing us with such, you renounce any possible claim against us and our affiliates with respect to any intellectual property rights vested in such Unsolicited Content, including, but not limited to, copyrights. We will also not compensate you in such instance. Any Unsolicited Content will be disregarded to avoid any possible misunderstanding around intellectual property rights vested in our Services. Receiving your submission of Unsolicited Content will not prevent us from offering, promoting, or developing products, services or games that compete with your Unsolicited Content, or working with others to do so. By submitting any Unsolicited Content to us, you agree to these terms.
6.6 Before, during and after using The Services, you may be invited to provide feedback (“Feedback”) to GamePoint relating to your experience of The Services. You hereby agree that to the extent that you provide any Feedback to GamePoint or any of its affiliates or to any of their respective employees, agents or contractors, you hereby assign, and agree to assign on a rolling basis, all right, title and interest in and to such Feedback to GamePoint and you waive all moral rights and similar rights throughout the world in and to such Feedback.
7. Intellectual Property Rights
All Intellectual Property Rights to The Services are owned by GamePoint (or its licensors). This Agreement does only provide for a license and does not transfer and/or sell any Intellectual Property Rights to The Services. All rights that are granted to you are expressly mentioned in and are limited by these Terms & Conditions, which means that no license, permission or right of access shall be implied.
8. Third Party Software & Distribution Partner T&C
It is possible that The Services includes third party software which GamePoint has obtained under a license. Additionally, the Distribution Platform T&C apply to your use of the Services. Consequently, GamePoint may be obliged to ensure that you comply with the terms and conditions of these licenses. If that is the case, GamePoint will notify you of these terms and conditions. Your use of the Services is subject to your compliance with these terms and conditions and by agreeing to these Terms & Conditions, you also agree to be bound by the terms and conditions of these licenses. In case the contents of these Terms & Conditions conflict with the terms and conditions of third parties, the terms and conditions of third parties will prevail.
9. Conformity and liability
9.1 The Services is provided on an “as is” basis without any warranty of any kind. This means that GamePoint does not guarantee that The Services is free from bugs and/or defects, works flawlessly and/or is available at all times. This also means that there may be times where the Services is not available for technical or (scheduled and/or unscheduled) maintenance related reasons.
9.2 To the maximum extent permitted by applicable law, GamePoint shall not be liable to you under contract, tort (including negligence) or otherwise for any losses, such as loss of data, profits, revenue, business, opportunity, goodwill, reputation or business interruption or for any losses which are not reasonably foreseeable by us arising, directly or indirectly from:
Your use or inability to use the Services;
Delays or disruptions of the Services;
Viruses or other malicious software obtained by accessing, or linking to, the Services;
Damage to your hardware from the use of the Services;
The content, actions or inactions of third parties;
A suspension or other action taken with respect to your use of the Services.
9.3 To the maximum extent permitted by applicable law, you agree that the aggregate liability of GamePoint to you for all claims arising out of, or relating to the use of, or any inability to use any part of, The Services or otherwise under this Terms & Conditions, whether under contract, tort, or otherwise, is limited to EUR 500 (five hundred euros).
9.4 Nothing in this Terms & Conditions shall limit or exclude GamePoint’s liability for fraudulent misrepresentation, death or personal injury resulting from its negligence or the negligence of its agents or employees or for any other liability that cannot be limited or excluded by applicable law.
9.5 You accept sole responsibility for the legality of your actions under the laws applying to you and the legality of any of your User Generated Content.
9.6 You will compensate GamePoint in full for any losses or costs, including reasonable legal fees, it incurs arising out of any breach by you of this Terms & Conditions, your improper use of the Services or your infringement of any law or the rights of a third party.
10. Updates & changes to the Services
10.1 GamePoint may supply or make available Updates to the Services:
In case of the Website, these Updates will be made available by adjusting the Website;
In case of an Application, any Update will be automatically downloaded when using the Services. It is necessary to install any Updates before continuing to use the Services. In case you do not download any Update to the Services, you will not be able to play The Services.
10.2 You acknowledge that GamePoint will use technical measures to enforce article 10.1 of this Terms & Conditions.
10.3 GamePoint has the right to make a change to the Services or to cease offering a part of the Services at any time, including but not limited to in the following circumstances:
In the event of technical reasons;
In the event of commercial reasons (when it is no longer commercially feasible to keep offering the Services);
In the event of legal reasons;
In the event we simply have changed our offering within the Services.
11. Term & termination
11.1 These Terms & Conditions comes into force upon your acceptance of thereof and will continue to remain into effect until it is terminated in accordance with the terms and conditions of this Terms & Conditions.
11.2 GamePoint may terminate these Terms & Conditions and your use of The Services at any time.
11.3 Without prejudice to other remedies, GamePoint may immediately restrict, suspend, or terminate these Terms & Conditions and thus your access to and use of the Services, or any part of them, in the following cases:
GamePoint has reasonable cause to believe that you are creating problems or possible legal liabilities for, or are infringing the rights of, GamePoint, any of our Users or third parties;
GamePoint has reasonable cause to believe that such restrictions will improve the security of the the Services community or reduce our or a User’s exposure to financial liabilities;
GamePoint has reasonable cause to believe that you are violating these Terms & Conditions or any other applicable rules and/or policies. In the event of violations of the Terms & Conditions relating to child abuse and/or exploitation, GamePoint will remove the Content upon becoming aware of such, block the Account and report it to the local authorities;
GamePoint is unable to verify or authenticate any information you have provided after making reasonable efforts to do so.
11.4 If this Terms & Conditions and/or your use of the Services has been terminated or suspended by GamePoint, you may no longer use the Services.
12. Changes to these Terms & Conditions
GamePoint has the right to unilaterally update and/or change the terms and conditions of this Terms & Conditions. You will be notified in advance of any updated and/or changed terms and conditions of the Terms & Conditions via the Services and/or the applicable Distribution Platform. Your continued use of the Services after a change of the terms and conditions of this Terms & Conditions constitutes your acceptance of these terms. In case you do not want to be bound by the amended terms and conditions, you have the right to terminate these Terms & Conditions by [email protected].
13. Additional terms
13.1 These Terms & Conditions constitute the entire and exclusive understanding and agreement between GamePoint and you regarding the Services. These Terms & Conditions supersede and replace any and all prior oral or written understandings or agreements between GamePoint and you regarding the Services.
13.2 You cannot assign or otherwise transfer these Terms & Conditions or any right granted or obligation imposed hereunder, except in case you have received prior written consent of GamePoint for the assignment or transfer. GamePoint may freely assign or transfer these Terms & Conditions without restriction, providing that the transfer does not serve to reduce the guarantees benefitting you under these Terms & Conditions.
13.3 If any term of these Terms & Conditions is held invalid or unenforceable by a court of competent jurisdiction, that term will be deemed not to form part of these Terms & Conditions, but the remainder of these Terms & Conditions shall remain in full force and effect.
13.4 GamePoint’s failure to act with respect to an infringement or breach by you or others does not waive its right to act with respect to subsequent or similar infringements. GamePoint do not, and cannot, guarantee that it will take action against all infringements or breaches of this Terms & Conditions.
13.5 Where these Terms & Conditions specify that GamePoint shall provide written notice to you, GamePoint may do so by: (a) sending the notice to any email address supplied or made available by you; or (b) publishing a notice, addressed to users of the Services generally, on its website.
13.6 These Terms & Conditions shall be governed by and construed under the laws of the Netherlands.
13.7 Any and all disputes arising from or in connection with this Terms & Conditions shall be subjected to the exclusive jurisdiction of the court of The Hague, the Netherlands.

GamePoint provides an online platform with game-specific websites, including the website www.gamepoint.com (the “Website”), games made available through our Website (“Game(s)”) and all related services, such as mobile apps and a launcher to install Games on your desktop (hereinafter referred to as: the “Services”).

13.2. We want to ensure that your personal data is accurate and up-to-date. You can edit all this data yourself by logging in to our Website and updating your profile. If there are any factual inaccuracies in the personal data you requested that you cannot edit yourself on the Website, GamePoint can edit it for you at any time.
13.3. We do not use automated data processing, do not sell your data to third parties, and do not use it for cross-contextual advertising. Furthermore, we do not discriminate when you exercise your rights under applicable privacy laws and regulations.
13.4. Data you share through our Services on any social network or third-party platform cannot be modified or deleted by us if it is controlled by that social network or third-party platform. Furthermore, if a third party copies data you have shared through our Services (for example, one of your friends on a social network who is allowed to interact with your account), we may not be able to modify or delete that data because that data is not controlled by us.

13.6. You have the right to delete your personal data or restrict the processing thereof. You can submit a request to do this by contacting customer service. Please be sure to include your contact details or username. After submitting a deletion request, you have fourteen (14) days to withdraw your request.
